1) Scope of Services

Evervent Pvt. Ltd. provides a comprehensive digital platform designed for efficient employee benefits management and wellness programs. The core Services we offer include:

• Understanding and assessing your organization’s needs for employee benefits and wellness programs.
• Providing personalized recommendations for benefits packages that align with your organization's goals.
• Enabling employers and employees to manage and access various benefits and health services via our user-friendly platform, including web and mobile apps.
• Personal Data" refers to any information that can identify an individual, such as name, email address, phone number, job title, etc.
• Offering continuous support for the management and optimization of employee benefits.

Our platform connects employers, employees, and service providers to ensure seamless access to a wide range of health management and employee benefit solutions.

Please note: Evervent Pvt. Ltd. cannot be held responsible for service failures caused by external factors such as network issues, third-party service failures, or user errors. We cannot guarantee uninterrupted access to the platform at all times.

2) User Responsibilities

You are responsible for ensuring the accuracy and completeness of the information you provide us with. Evervent Pvt. Ltd. will rely on the data provided by you to deliver the Services, and we cannot be held liable for any issues arising from incomplete, inaccurate, or outdated information provided by you.

You agree that you are responsible for maintaining the confidentiality of your account credentials and for ensuring that any individuals granted access to your account are authorized users. Evervent Pvt. Ltd. will not be held responsible for any unauthorized access or misuse of your account information.

Important Note: Evervent Pvt. Ltd. will not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising from:

• The use or inability to use the platform.
• The failure to provide or the disruption of services.
• Any transactions carried out based on instructions provided by you.
• Loss or damage caused by defects, errors, failures, or interruptions in service provision.

Evervent Pvt. Ltd. expressly disclaims any responsibility or liability for deficiencies in services provided by third parties, whether or not such third parties are affiliated with Evervent Pvt. Ltd..

3) Company Obligations

Evervent Pvt. Ltd. will handle all information provided by you with the highest level of confidentiality. Information will only be disclosed in furtherance of its business relationship with you and for legitimate business purposes, including compliance with applicable data protection regulations. Sensitive personal information will be managed in accordance with the provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

It is made clear that Evervent Pvt. Ltd. does not take any responsibility, liability, or warranty regarding the accuracy, completeness, or correct sequence of content, services, or any third-party information, including services offered on external websites.

4) Termination of Services

Either party may terminate this agreement by providing written notice at least 90 days in advance. Upon termination, Evervent Pvt. Ltd. will continue to support any active services or benefits products that are ongoing until their term expires, unless you instruct us otherwise at the time of termination.

5) Marketing and Communications

By using our platform, you grant Evervent Pvt. Ltd. permission to send you information regarding products, services, or updates that may be of interest to you. This may include newsletters, promotions, and feature updates. You can opt out of receiving such communications at any time by notifying us in writing, and we will ensure that no further marketing communications are sent to you.

6) Governing Law and Jurisdiction

In case of any dispute arising from these T&Cs, the products, or policies governing your use of our platform, the Courts located in Chandigarh, India, will have exclusive jurisdiction. These T&Cs and any related agreements will be governed by and interpreted in accordance with the laws of the Republic of India.

7) Limitation of Liability

Evervent Pvt. Ltd. is not liable for losses or damages resulting from your inability to access or use the platform, whether due to internet disruptions, technical failures, or unauthorized access by third parties.

Furthermore, Evervent Pvt. Ltd. shall not be held liable for any indirect, punitive, or consequential damages arising from the use of our Services, even if we have been notified of the potential for such damages.

While we strive to ensure the platform’s availability, we are not responsible for external factors or circumstances beyond our control that may affect service performance.
